This is a legally binding agreement, waiver, and release and is hereinafter called “Agreement”, is entered into by and between Will Ashcraft, Michael Baker,

Larry Pacifico, Ashcraft’s Academy of Martial Arts and Fitness LLC, MPower Gym LLC, MPower Sports Performance LLC, Pacifico Power Systems LLC(all Limited

Liability Companies) employees, volunteers, and agents, hereinafter all collectively referred to as “AAMAF/MPG/PPS”, with an address of 270 N. Dixie Drive, Vandalia,

OH 45377

This is an agreement for training of Athlete/Trainee by Will Ashcraft/Michael Baker/Larry

Pacifico/AAMAF/MPG/PPS, Athlete/Trainee subcontractors, employees, volunteers or agents, or in the event of a minor, Athlete/Trainee’s

parent(s)/legal guardian(s), hereby state and agree to the following in consideration for value received:

1. I state I have no medical condition(s) or injuries that would prevent me from safely participating in physical training. I have no medical

restrictions and no physician has advised me to restrict my physical activity. I understand I am under a duty to alert AAMAF/MPG/PPS

of previous, current, or future restrictions by any physician or medical provider. I understand that if I have a condition or medical

restriction I must obtain a release by my Physician/Provider to participate in physical activity before participating in exercises and

training with AAMAF/MPG/PPS. and

2. I understand that this training has inherent physical risk. I agree that by participating I am assuming all risks associated with physical

activity, equipment, and exercises; and

3. I agree to follow all directions, follow guidelines, procedures, processes, and all safety instructions; and

4. I am responsible for my own safety and to participate in a manner that ensures the safety of others and

5. I agree to immediately alert the trainer to any dangerous activity or action or safety violations I witness; and

6. I am responsible for maintaining my own health and accident insurance; and

7. That AAMAF/MPG/PPS has express permission to contact me directly via text, email, phone, or social media, and anytime between

8:00 am to 10:00 pm

8. I understand that I am to conduct myself in a professional manner and that any horseplay, bullying, excessive roughhousing, profanity,

imposition, or unwanted touching is grounds for immediate dismissal from AAMAF/MPG/PPS training

9. I agree to not be under the influence of drugs and/or alcohol, I agree to alert my trainer regarding any prescription medications I might

be taking; and

10. I grant AAMAF/MPG/PPS permission to use video, audio, and photography of myself for marketing, and promotion. I understand that

this media may be used on Facebook, Instagram, Twitter, and other social media. In addition, is granted permission to use this media in

AAMAF/MPG/PPS website, brochures, posters, flyers. and social media outlets; All rights to the content belong to AAMAF/MPG/PPS.

This media release is irrevocable and ongoing and binding to my heirs and assigns; and

11. I understand I am under a duty to immediately report to my trainer any unusual physical symptoms such as dizziness, being

lightheaded, chest, shoulder, neck. leg or back pain, shortness of breath, coldness, failure to sweat during exercise, palpitations, or any

other symptoms

12. I Understand that AAMAF/MPG/PPS is a drug-free zone and that if I am caught using, selling, or purchasing drugs on the property my

account will be revoked and that I will be trespassed from the property.

AGREEMENT/INDEMNITY/WAIVER/RELEASE OF LIABILITY/ACKNOWLEDGEMENT In consideration for being allowed to participate in this

activity, which Athlete/Trainees, or in the event of a minor, Athlete’s/Trainee’s parent(s)/legal guardians agree for themselves do freely and

voluntarily for my own personal benefit, we hereby take action for myself, my executors, administrators, heirs, next of kin, successors and assigns

to:

1. waive, release and discharge from all liability to Will Ashcraft, Michael Baker, Larry Pacifico AAMAF, MPG, PPS officials, employees,

subcontractors, students, agents, and volunteers for my death, disability, personal injury, property damage, or property theft, or actions of any

kind which may hereafter accrue to me.

2. Indemnify and hold harmless Will Ashcraft, Michael Baker, Larry Pacifico, AAMAF. MPG, PPS employees, subcontractors, students, agents, and

volunteers, from all liabilities or claims, suits, damages made by other individuals or entities as a result of or relating to my participation in this

activity.

Therefore, intending to be bound and as a condition of being allowed to participate in AAMAF/MPG/PPS training and exercise, I have freely

signed this waiver on the date indicated.

I/We acknowledge I/We have read this document in its entirety, fully understand its terms, and understand that I/We are giving up substantial

rights – including my right to sue. I/We know, understand, and appreciate these and other risks that are inherent in the Activity. I/We expressly

agree and assert that participation in the Activity is voluntary and I/We knowingly assume all such risks and elect to proceed with the

participation despite all the risks. I/We acknowledge that I/We are signing this document freely and voluntarily and intend, by my signature, the

complete and unconditional release of all liability to the greatest extent allowed by law.

Coronavirus-19 Pandemic add on:

Athlete/Trainee hereby acknowledges that a risk of training with AAMAF/MPG/PPS, that, while AAMAF/MPG/PPS will take all

reasonable steps to maintain cleanliness and to provide as germ-free of an environment as possible, I may be exposed to COVID-19

or some other contagious virus carried by another Athlete/Trainee or staff user, that Athlete/Trainee is knowingly and voluntarily

assuming that risk, including the risk of contracting said virus, becoming ill from it, or even dying from it. Athlete/Trainee hereby

waives and releases any and all claims against any of AAMAF/MPG/PPS, as well as any of its owners, directors, managers, employees,

contractors, and/or agents from any and all claims of liability arising from or out of any exposure to COVID-19 or any other

contagious virus or disease while at the premises of AAMAF/MPG/PPS, while using any of the equipment owned by

AAMAF/MPG/PPS, or from any interactions with any person at or associated with AAMAF/MPG/PPS. Further, Athlete/Trainee further

agrees that if Athlete/Trainee is not feeling well, the Athlete/Trainee will not come to the premises of AAMAF/MPG/PPS and will take

all necessary steps to avoid infecting others. Finally, the Athlete/Trainee agrees that if any staff member of AAMAF/MPG/PPS

indicates that Athlete/Trainee should leave due to apparent ill-health, the Athlete/Trainee shall immediately leave the premises and

shall not return until Athlete/Trainee has recovered from said illness.
